*पग पग पलटती पदोन्नति की प्रक्रिया*
न्यायमूर्ति शाही के फैसले के बाद पदोन्नति को लेकर जब भी प्रयास किया तो सरकार माननीय न्यायालय में कहती कि पदोन्नति पर न्यायालय में वाद है। अंततः यह बताना पड़ा कि दिनांक २३/०८/२०१० के पूर्व नियुक्त लोगों पर विवाद है। इसके बाद नियुक्त लोगों पर कोई विवाद नहीं है। पदोन्नति प्रक्रिया प्रारंभ होने पर एनसीटीई का नोटिफिकेशन न फॉलो होने पर माननीय न्यायालय गया तो दिनांक ०३/०५/२०२३ को बेसिक शिक्षा विभाग ने कहा कि अभी यह वरिष्ठता सूची है पदोन्नति करते समय एनसीटीई का नोटिफिकेशन लागू होगा। माननीय न्यायालय से पुनः न्यायालय आने की लिबर्टी प्राप्त हुई।
उसके बाद दिनांक ०२/०६/२०२३ को मद्रास उच्च न्यायालय ने स्पष्ट कर दिया कि एनसीटीई का नोटिफिकेशन दिनांक २३/०८/२०१० का पैरा ४ सर्विस जारी रखने की अनुमति देता है। पदोन्नति में टीईटी से राहत नहीं है। पदोन्नति में जिस संवर्ग पर जाते हैं उसकी योग्यता होनी चाहिए। आदेश के अनुपालन में एनसीटीई ने दिनांक ११/०९/२०२३ को पत्र जारी कर दिया। पदोन्नति में एनसीटीई की अधिसूचना न लागू होने पर पुनः कोर्ट गया एवम प्रक्रिया रुक गई।
तमिलनाडु सरकार माननीय सर्वोच्च न्यायालय गई है एवम डायरी नंबर ४५६४९/२०२३ एवम ४४५९०/२३ पर बगैर टीईटी नियुक्त लोगो को बगैर टीईटी पदोन्नति करने की मांग कर रही है।
इस तरह वर्तमान में यूपी सरकार सब पर टीईटी लगाकर ही पदोन्नति कर सकती है। जिन्हे आपत्ति हो उनके लिए डायरी नंबर ४५६४९/२३ व ४४५९०/२३ याचिका के आधीन टीईटी वालों की पदोन्नति कर सकती है।
अब यह सम्भव नहीं है कि बगैर एसएलपी निस्तारण के किसी की पदोन्नति हो।
Step by step promotion process
After Justice Shahi's decision, whenever efforts were made for promotion, the Honorable Court would say that there is a stay on promotion from the Court. Ultimately it had to be stated that there is a dispute over the people appointed before 23/08/2010. There is no dispute over the people appointed after this. When the notification of NCTE was not followed at the beginning of the promotion process, when I went to the Honorable Court on 03/05/2023, the Basic Education Department said that this is the seniority list and the notification of NCTE will be applicable at the time of promotion. Got liberty to come to the court again from the Honorable Court.
Thereafter, on 02/06/2023, the Madras High Court clarified that para 4 of NCTE's notification dated 23/08/2010 allows continuation of service. There is no relief from TET in promotion. There should be qualification for the cadre in which one goes for promotion. In compliance with the order, NCTE issued letter dated 11/09/2023. When NCTE notification was not implemented in promotion, we went to court again and the process was stopped.
The Government of Tamil Nadu has gone to the Honorable Supreme Court and is demanding promotion without TET to the people appointed without TET on Diary No. 45649/2023 and 44590/23.
In this way, at present the UP government can promote everyone only by imposing TET. For those who have objection, TET candidates can be promoted under the petition diary number 45649/23 and 44590/23.
Now it is not possible for anyone to be promoted without disposal of SLP.
