शिव कुमार शर्मा और राम प्रकाश शर्मा केस में हाई कोर्ट की फुल बेंच निर्णय कर चुकी है कि NCTE का नोटिफिकेशन और गाइडलाइन बेसिक शिक्षा नियमावली पर प्रभावी है ।
_Hon'ble Pankaj Bhatia,J.In terms of the order passed by this Court on 17.02.2023, Shri Ran Vijay Singh, learned counsel for the respondent based upon instructions states that the qualification prescribed by NCTE are implicit in the notice dated 31.01.2023 and while making promotions, only the persons who have the qualification prescribed by NCTE by notifications issued from time to time shall be considered. The instructions are taken on record.In terms of the said concession as recorded by Shri Ran Vijay Singh, learned counsel for the respondent, nothing survives in the present petition. The present petition stands disposed off._
